San Diego-based independent record label, Pacific Coast Jazz, announces overseas distribution deal with UK-based disbitributor, "The Woods."
San Diego, CA (PRWEB) October 31, 2005 -- San Diego-based independent record label, Pacific Coast Jazz, has cut a deal for overseas distribution by UK-based, The Woods. The Woods began exclusively distributing the label’s catalogue in the United Kingdom as of October 1, 2005. They are the first European distributor to sign with the label.
Currently Pacific Coast Jazz has a boutique catalogue, comprised of the recordings of jazz flutist Bradley Leighton. Leighton has two records available on the label, “Just Doin’ Our Thang” (May 2005) and a national release of a 2003 recording, “Groove Yard,” (August 2005), both of which will be distributed in the UK by The Woods. The label is now gearing up for the US/UK release of Leighton’s third recording effort, slated for January, 2006, “Back to the Funk.” “We wanted to get involved because we really like the music,” says Trevor Flack of The Woods. “Leighton’s recordings are rooted in the jazz tradition but have a contemporary sound that we believe will appeal to a broader spectrum of radio stations.”
Pacific Coast Jazz, founded in 2003, is an independent jazz label that also offers artist management services. Donna Nichols, formerly a successful communications executive in the biotech industry, is the label’s founder and president. “When I started the label, I made a decision to follow my passion for music and combine that with my marketing and management expertise,” she says. Pacific Coast Jazz is actively pursuing the acquisition of new artists over the coming year. Until recently, the label’s focus has been primarily the straight-ahead jazz market, but the company will now handle contemporary jazz as well. “We want to grow slowly so that we can continue to give a lot of individual attention to each of our artists. We are looking for serious artists in both the traditional jazz and contemporary jazz genres. R/B Singer, Member of Soul Trio SURFACE Found Dead

R/B singer, producer, songwriter of the R/B group SURFACE dies.
(PRWEB) October 31, 2005 -- David Townsend from the 80's soft soul vocal trio SURFACE known for such lush ballads as "Happy", "Closer Than Friends", "Shower Me With Your Love" and the "The First Time" was found dead inside his Northridge, CA home Wednesday night (October 26) by a close friend. The cause of death was unknown. Townsend was 50.
SURFACE member vocalist/writer/producer DAVID TOWNSEND, was the son of the late legendary singer/songwriter/producer Ed Townsend. Ed Townsend was responsible for co-writing "Let's Get It On" by the late great Marvin Gaye and who had his own solo hit "For Your Love" back in 1958 . David Townsend followed his father's footsteps and wrote, produced, and performed with numerous artists over the past three decades. These artists included The Isley Brothers, Sister Sledge, New Edition, Rebbie Jackson, Jermaine Jackson and the legendary Aretha Franklin.
SURFACE'S Management (RDMJ Entertainment Management spokesman Randy Lopez) released a statement early this morning. "We are all shocked and saddened by the sudden death of David Townsend. He was one of the most down to earth and nicest person. He was such a great producer and a major talent. We will miss him."
Bernard Jackson and David "Pic" Conley of the group SURFACE released a statement today, "We are both shocked and very saddened by our loss of our close friend David. He was a great producer, songwriter and a great friend. We will miss him. We also want to say thank you to all our fans around the world for their love and support during this difficult time."
The dynamic million-selling group SURFACE has charted numerous times on the Billboard Magazine Pop and R/B charts over the past two decades.
In 1987, the group's self-entitled album peaked at #11 on the Billboard R/B Album chart which also spawned two top ten R/B singles, "Happy" and "Lately" and a top 25 R/B single "Let's Try Again".
The group's follow-up sophomore album "2nd Wave" which was released in 1989 was an instant smash and was certified platinum. The album peaked on the top of the R/B album charts at #5. The album released five singles, three of which went #1 on the R/B charts "You Are My Everything" featuring guest vocalist Regina Belle, "Closer Than Friends" and "Shower Me With Your Love". The latter song was certified gold and was a crossover hit on the Billboard Pop 100 singles chart peaking in at #5 and the Adult Contemporary chart at #3. The singles "Can We Spend Some Time Together" and the up-tempo dance floor cut "I Missed" were top 5 R/B hits.
In 1991, the group's third album "3 Deep" was released and was yet another success for the group. The first single from the album was titled "The First Time" which was certified gold and went #1 on the Billboard R/B, Pop and Adult Contemporary singles charts. The hits continued with "All I Want Is You" (peaked at #8 R/B) and "Never Gonna Let You Down" (peaked at #17 on the R/B and Adult Contemporary singles charts). The next single from the album "You're the One" reached # 24 on the R/B singles chart.
Due to the group's huge success and releasing numerous hits, the group's record company decided to release a greatest hit's package "A Nice Time For Lovin - The Best of Surface" which later spawned the single of the same name.
The group SURFACE was currently in the recording studio laying tracks for their new upcoming release due later next year. SURFACE is scheduled to perform at the Gibson Amphitheatre in Universal City, CA on December 29 and 30th, 2005.

CD Baby and Independent Musicians Donate $165,000 in CD Sales to Red Cross
PORTLAND, OR (SEND2PRESS NEWSWIRE) -- CD Baby (www.cdbaby.com) announced today that they raised a total of $165,000 over the past 7 weeks in concert with independent musicians and record labels who banded together to donate proceeds from their online CD music sales. Coming off the double-platinum 2003 hit, The Beautiful Letdown, Switchfoot officially begins a new U.S. tour on October 17th after spending time in Australia and Japan. “That’s kind of been our motto on every record, to play a lot of shows. That’s what makes the band,” says Tim Foreman.
Foreman explains that this album, Switchfoot’s fifth, is a very honest collection of songs. “Hopefully there’s been some growth over the last few years, new experiences, and that comes out in the songs,” he says.

A few times in the history of the chart, there have been a handful of heavy hitters who have been dominant, but this week it’s clear that no one is poised for more accolades than L.E.X. who enjoys rankings from not one or two, but six records, one of them having held the top spot last week.

In fact, the duo concedes that if they can’t keep a strangle hold on #1, a simultaneous #2 and #3 will do … for now. As fate would have it, L.E.X. is right there with Goapele’s “First Love” and The Veronica’s “4ever” holding down the fort at the top of the chart. Did we mention that at #39 L.E.X.’s remix of “I Don't Care” by Ricky Martin is a break out this week, their remix of “Deeper Love” by David Longoria featuring Cece Peniston has moved from #34 to #27, and “Night Of My Life” by (God, to say it makes us shiver) Barbara Streisand is creeping up, moving from #18 to #15.
The big news is, of course, continues to be Green, who can belt it out all on her own, but, for this chart topper, the diva had a little help from L.E.X., the production team comprised of superstar DJ Eddie X and Luigie Gonzalez.

Persian Piano Prodigy Vali's Debut Full-Length CD, “Destiny Is In Your Hands,” is the First Release on the New Rhythm Touch Records Label

Vali produced “Destiny Is In Your Hands,” as a way to send an inspirational message to the world. “Having a gift is one thing, and sharing it so that others can benefit is another,” says Vali. He believes “all things are possible. Where there is a will, there is a way!” The artist plans to promote his message by performing in concerts, appearing in radio interviews, and offering motivational speeches to students in schools and colleges nationwide.
Asked what led him to choose songs like “Yesterday,” “Careless Whisper” and “Lady in Red,” Vali responds, “Every time I’ve played these songs in public, people have just gathered around the piano, so I know they touch a chord with people.” Other titles featured on the CD include “Comme Amour,” “Besame Mucho,” “L’Italiano,” “Victory,” “Ballade pour Adeline,” “From Souvenirs to Souvenirs,” “Matrimonio de Amour,” “Golden Dreams” and “Ghorbat.” By recording this album, Vali shines new light on classic and familiar songs, including “Strangers in the Night,” “Love Story,” “The Godfather” and “Smooth Operator,” for his devoted and ever expanding fan base and the wider retail audience that is just now being exposed to his multi-cultural gifts.
Vali decided to take the unusual step of recording this collection of well-known themes from other composers for his debut album. He felt that, as an unknown artist, he could better introduce himself to new listeners by way of familiar tunes, so that people could first discover his talents as a pianist. Having accomplished that goal, Vali has now recorded an album of his own original compositions, titled “The Art of Relaxation,” twelve sonic collages that carry the listener on a journey of peace and tranquility, including such titles as “Universal Harmony,” Peaceful Moments” and “Sweet Surrender.”
Born in the Iranian capital city of Tehran, Vali came to the United States in 1984 and settled in the Los Angeles area, where he has raised his own family. Except for a few years spent at university in Florida, he has remained based in L.A. ever since.
“I want to feel that I contributed something positive,” says the Rhythm Touch Records instrumentalist. “My music and my thoughts are my gift back to society.” Vali fulfills this aspect of giving back to society through the humanitarian programs he has long supported. For close to a decade he has been affiliated with such charitable organizations as the Blind Children’s Center and the USO. He has also supported the Center Against Abusive Behavior and the World Children’s Transplant Fund. Vali is donating a portion of the profits of his new instrumental collection, “Destiny Is In Your Hands,” to programs that will inspire and support people who truly need help. In addition to the Blind Children’s Center, these include USO Operation Phone Home, a campaign designed to provide prepaid international calling cards to as many of our service men and women overseas as possible, so they may call their loved ones at home.
The keyboard virtuoso expresses his appreciation for the creative contributions of Sun Valley, California, music maker and studio owner Roma Kanyan, who helped guide him through the initial journey in the studio arena. “I love Roma’s creative talent,” Vali enthuses. “He’s a great complement to my projects.” Besides the use of his studio, Kanyan’s contributions included arranging, programming, sequencing and mixing the tracks, as well as playing various keyboards and accordion. His innovative arrangements have enhanced the recent recordings of many new and established stars on the Persian-American music scene.
The ambience of California and the West Coast has obviously influenced Vali’s music and recording, from the studio to the mastering room, but his motivation comes from other sources too. “I feel the energy of the U.S.A.,” Vali says of his adopted homeland. “I always take my inspiration from God. I think all men and women who have come here from other countries are very fortunate to be living in America. I love this country and appreciate all the wonderful opportunities it offers me.”

Swinging Steaks 'Sunday Best' CD A Labor Of Love For New Record Label
Swinging Steaks new CD, 'Sunday Best' was a labor of love for First National Records founder.
(PRWEB) October 10, 2005 -- Like most music fans, Dave Witthaus often thought it would be great to own a record label. But, like most music fans, he never thought he'd do it.
That all changed in early 2005 after a conversation with Paul Kochanski, the bass player in the legendary Americana band, the Swinging Steaks. "Paul mentioned that their latest CD, 'Sunday Best' had been released in Europe, but not in the US" said Witthaus. "The CD was selling well in Europe, and the band had been approached by several US labels, but with all the turmoil going on in the record industry, some of those labels folded, a few went on 'hiatus', and others placed demands on the band that weren't reasonable." For the time being the CD was only available as an import through a few US retailers and the band's website ( www.swingingsteaks.com ).
Witthaus, a fan of the band, decided to change that. "This CD was too good not to be available nationally." He approached the band backstage after a show with his idea of starting a label and releasing "Sunday Best". After showing the band his plans and explaining that he would be the "least corporate corporation they could ever hope to be involved with", they agreed to sign on.
Witthaus has owned Platterpus Records, an independent record store in Westfield, MA, for the past 23 years. He also spent 9 years in radio, including 3 as Program Director of Springfield, MA, AAA station WRNX. "I knew my way around the industry a bit, but starting a label put me in new territory"
After a lot of research, phone calls, e-mails, and a bit of luck, the project started moving along.
Needing a national distributor, Witthaus made a cold call to Redeye Music Distributors, a highly regarded CD distributor based out of North Carolina www.redeyeusa.com. "These guys were my first choice. I knew from experience at my store that they were small enough to take care of little guys like me, but big enough to make sure that the CD was available to every music retailer in the country". Luck kicked in when the person on the other end of the phone at Redeye turned out to be a Swinging Steaks fan. Redeye soon agreed to distribute the CD.
Witthaus named the label First National Records ( www.firstnationalrecords.com ). "I named it after one of the credit cards I maxxed out to get the label started", Witthaus stated. "I know that's not the text-book way of funding a business, but when I went to the banks for a loan and told them I wanted to start a record label, they looked at me as if I just said I wanted to open a Yugo dealership. I want to prove them wrong."
Released last month, Swinging Steaks "Sunday Best" has been greeted with glowing reviews, nationwide AAA and Americana airplay, and better than expected sales.
"It's been a lot of work, but so far it's been all worthwhile" say Witthaus.
First National Records will be a full service label and plans to release CDs from other artists. "I have no idea how many CDs we'll release over the next few years. We'll be going for quality, not quantity. Swinging Steaks set the musical bar very high. Anybody we sign will have to meet or exceed that level of musical excellence."

Indie Bands Unite
TORONTO (PRWEB) October 7, 2005 -- In early July 2005, two aspiring musicians from Toronto took it upon themselves to solve the ever-present issue facing independent bands today, ‘exposure’.
Having been a part of the music scene for nearly 10 years, it became apparent to co-founders Winston So and Jason Kent that the band community not only in Toronto, but those all across Canada needed help. That ‘help’ came in the form of an online web community called Indie Band Canada, which launched on September 10th of this year. It was obvious to the creators of Indie Band that there needed to be an outlet for Canadian musicians to utilize, so an online radio station was created in conjunction with Indie Band called IBC tunes.
Indie Band Canada was designed to be a website for musicians by musicians. The idea of Indie Band came about through a desire to unite the surging band growth happening all across Canada. The online band community had been done to a certain extent before, however there is something different about the way Indie Band Canada has been put together. The difference was the people who created Indie Band are the same who were meant to use the site. The focus of the site will always be an outlet for the independent musician in Canada to be heard.
Co-founders Kent and So knew the one way to help any independent band is to have their music played for a large audience. This is accomplished by designing the first independent band radio station in Canada, IBC tunes. IBC tunes operates with a random sampling of all the songs uploaded by bands in the Indie Band community. IBC tunes is meant to operate in the same way a traditional radio station does. Just like turning on your radio, IBC tunes is started with one click to hear all the newest underground music in Canada.
Keeping the community aspect of Indie Band alive, Kent and So designed the whole website to operate completely free of cost for the bands. “The focus of Indie Band Canada will always remain the music first and foremost, we are fans too,” says Kent.

A team of hard working and dedicated individuals joined together to form New Goth America, Inc. - all with the dream of making Goth Stock 2005 a reality.
Goth Stock 2005 was a concept created by Charles Cudd, CEO, and Marina Chernova, Administrative Coordinator. In addition to organizing the event, handling all air and hotel reservations, and taking care of vendors, Charles Cudd and Marina Chernova also performed at the event in their NY based band Dead Emotion. All of the bands were booked thru the Event Coordinator, Tazz Cortes of Lethal Zone Productions, with the exception of 11 bands brought to the event by Diego Santos of Evil Empire Entertainment, who also sponsored the second stage. The stages were run by Stage Managers Jonathan Burko of Artillery Promotions and Michael Caccavale of El Diablo Productions. Publicity and sponsorship coordination services were provided by Michele Haro of WC Productions and full catering services were provided by Angelo Competiello of Artillery Promotions and A.S. Fine Foods of Thornwood, NY.
"Many of the large festivals in the U.S. are only available to either other genres of music, mainstream artists, or those that are willing to pay to play. Our goal was to beat that system and grant that type of opportunity to the many talented musicians that otherwise may never experience such a festival appearance." says Michele Haro, Publicist for New Goth America, Inc.
"So many underground and up-and-coming artists are forced to pay hundreds, even thousands, of dollars just to be able to appear on the same stage with a major headliner. These bands work very hard and are so willing to devote every penny for the possibility of the recognition that may or may not come with the larger festivals. Goth Stock is that opportunity, minus the erroneous costs."
After months of planning, New Goth America, Inc. has accomplished their goal. Goth Stock 2005 was a huge success and will hopefully set the stage for future events. Rebecca Kowalewicz, manager for Carfax Abbey, says "The staff was well organized, timely and mostly accommodating. For having to undergo such a task as having a huge number of bands in heavy rotation, they seemed to have everything under control and in hand."
Kowalewicz continues, "The stage set up was great, the techs friendly and helpful and the sound was very good as well. I think that, if moved to a more populated area, Goth Stock has the potential to become a major name in the Gothic Festival circuit. Location is a key!"
"Attendance could always be better, but that comes from a lack of support in the music scene these days. Many artists are feeling the decline in live performance attendance and so many people do not practice what they preach when it comes to supporting music, " Haro says.
Noel Ramos of IndieGate.com, Online Independent Music Store, was in attendance of the show. "I was extremely pleased with the entire Goth Stock experience. Charles and his crew did an exemplary job of creating exactly what they had promised, an awesome gathering of bands and their fans at a venue perfectly suited for the event. Musicians Worldwide Heed the Call to 'Harmony for Humanity'
Thousands to participate in fourth annual Daniel Pearl Music Days events and e-Stage
Los Angeles, CA - October 2, 2005 – From Elton John, Los Lobos and the London Philharmonia to Pakistan's MTV award-winning band Strings, hundreds of performances worldwide are scheduled throughout October as part of the Fourth Annual Daniel Pearl Music Days (www.musicdays.org), a global network of musical events on Oct. 1-10. Concert registrations from both amateur and professional musicians are flowing into the Music Days website daily to join this international phenomenon of “Harmony for Humanity.”
Daniel Pearl Music Days began in 2002 as an international “jam session” to commemorate the Oct. 10 birthday of murdered journalist Daniel Pearl, who played classical, jazz and bluegrass music wherever he traveled. It's always very gratifying for me to see a huge smile come over a child's face when he or she is able to play a melody or phrase they didn't think they could get. Then Voila! The child realizes "Hey, I did it once, so I can do it again!"
Listening to music also teaches important prereading skills. When children learn to strum on the guitar, or play their first chords on the piano, they can play the rhythmic pattern of words. They learn to differentiate between a fast and slow tempo, changes in volume with the music getting louder or softer, and instruments played one at a time and together, etc. When they try new instruments, they notice how each new sound changes the music.
Students of music and other arts continue to outperform their non-arts peers on the SAT, according to reports by the College Entrance Examination Board. As a whole, in 1995, SAT-takers with experience in music . . . scored 51 points higher on the verbal portion of the test, and 39 points higher on the math portion, as compared to students with no experience. And longer arts study means higher SAT scores: in 1990, those who had studied the arts four or more years scored 59 points higher on the verbal and 44 points higher in the math portion, than students with no experience in the arts.

Saul Davis-Zlatkovsky receives ASCAP award, named Harp Forum Editor of American String Teacher magazine
Saul Davis-Zlatkovsky, Philadelphia harpist-composer received an ASCAP award recognizing the prestige value and performances of his compositions. He was recently appointed Harp Forum Editor of American String Teacher magazine. His music was performed at the Curtis Institute of Music and the American Harp Society National Conference held at the University of Pennsylvania in Irvine Auditorium.
PHILADELPHIA (PRWEB) September 28, 2005 -- Saul Davis-Zlatkovsky, harpist-composer, has received an ASCAP award, annually given to serious-music composing members for “prestige value” and performances of their work.
Mr. Davis-Zlatkovsky’s works were performed in Philadelphia at the Curtis Institute of Music and the National Conference of the American Harp Society in Irvine Auditorium at the University of Pennsylvania, in 2004. He was recently appointed Harp Forum Editor for American String Teacher, the national publication of the American String Teachers Association. He is also Harp Editor for String Notes, the Minnesota chapter publication which received ASTA’s national award for best publication. He recently performed an acclaimed solo recital in remembrance of his teacher, Lucile Lawrence, for the American Harp Society’s Philadephia Chapter. He was commissioned by the Simpson-Flanagan Harp Duo to arrange for them the Mozart Flute and Harp Concerto as a Flute and Harp Duo Concerto.
Musical compositions by Mr. Davis-Zlatkovsky which were performed were Suite Provencal for Harp Duo, a seven-movement work; and American Pictures: Prairie Night, a harp solo. The Suite was premiered by Sonja Wangensteen and Piper Runnion-Bareford of the Curtis Institute of Music, and Prairie Night was premiered by Emily Halpern-Lewis, harp faculty member of Boston University and MIT.
Mr. Davis-Zlatkovsky has been a resident of Philadelphia since 1994. He performs regularly in recital, has performed with area ensembles including the Concerto Soloists Chamber Orchestra and the New Jersey Symphony Orchestra, and the Presbyterian Churches of Doylestown, Wilmington, Haddonfield, and others. He has a duo, Aeolian Harps Concert Harp Duo with harpist Virginia Flanagan.

I also love to compose settings for folksongs, which I consider original compositions as they take as much time and thought as any new piece, if not more. I have set at least 85 French folk songs, 8 or so American, and about 5 Sephardic songs, so far. I intend to continue to perform recitals as much as possible, but it is sometimes hard to find enough time to prepare.”
“People always ask me, ‘why don’t I perform my own music?’ I try to tell them, the composing process isn’t complete until I can hear someone else play my music. That way I know how well I have been able to communicate my idea to them, and if it needs any revisions. The purpose of composing is to provide others with music, not myself. As a performer, I need the interchange with the composer of the music, with my own music it is just myself, and I have already spent the time composing the music, so I have less desire to practice it, as it becomes more purely a physical routine, or perhaps I am a little scared of it. Also, I am continually tempted to revise a piece, so that makes it extremely difficult to say it is finally done. My pieces need some time to age as part of the process, so many of them are too new to perform, and the oldest ones don’t represent me quite as well it seems.”

A Disgusted KISS Army Puts Rock & Roll Hall of Fame on Notice
Fans of the makeup-wearing rock legends KISS announce plans to protest at the Hall of Fame in Cleveland in response to repeated omission of KISS on the Hall's ballots.
(PRWEB) September 27, 2005 -- In response to the announcement of the finalists for this year's Rock & Roll Hall of Fame inductions, fans of rock group KISS have issued a warning to the Hall: “We're sending in our forces.”
Known as the KISS Army, fans of the make-up wearing, blood-spitting icons say they are tired of the lack of respect given to the 70s icons who are still playing to packed stadiums 30 years after their creation.

D'Angelo got Naked for Voodoo, now after Hummer Crash can we expect more of the same?

D'Angelo who once sang naked for his curiously titled song and video, Untitled (How Does It Feel), said he is ready to continue working on his upcoming album after a car crash left him hospitalized for two days. After capturing two Grammy Awards in 2001, one for best male R&B vocal performance for "Untitled (How Does It Feel)," and the second for his album "Voodoo", D'Angelo had largely faded from the public eye with the exception of several relatively minor drug and alcohol arrests.
D'Angelo, 31, born Michael Eugene Archer, was a passenger in a 2003 Hummer on Sept. 19 when it crossed the roadway and struck a fence ejecting the R&B singer from the vehicle. He was not wearing a seat restraint when the accident occured.
Originally listed in critical condition, D'Angelo suffered only bruises from the crash. The cause of the crash is under investigation.

Jay-Z: Def Jam President, Rap Mogul
Jay-Z, whose real name is Shawn Carter has taken over as the president of Def Jam Recordings. With 10 albums released in less than ten years for a current total of over 33 million copies sold as well as winning four Grammy Awards, Jay-Z has the proven savvy and talent of a major player in the music business. The real question is if Jay-Z, 35, can parlay his creative experience and apply it to the day-to-day demands of a corporate CEO.
Creative artistry and business acumen are not mutually exclusive but it remains to be seen which of Jay-Z's personas will take precedent: that of Jay-Z, rapper, or the one belonging to Shawn Carter, Def Jam Recordings President. Most likely we will see a blending of both. I suspect Jay-Z/Shawn Carter has what it takes for the job. If he does, look for some major announcements from Def Jam Recordings in the near future. The next few months should be interesting.

Warner Music Group Corp. Reports Fiscal Third Quarter Ended June 30, 2005 Results
Warner Music Group Corp. announced its third quarter financial results for the three-month period ended June 30, 2005. Reported net loss was $179 million or $(1.41) in earnings per share. Excluding $135 million in non-recurring after-tax expenses and $9 million in FAS 123 expenses, adjusted net loss was $35 million, or $(0.27) per share for the quarter. These non-recurring charges described below relate to specific IPO-related one-time events and do not reflect on-going operations of the business.
* Warner Music Group Corp. revenues grew 2% to $742 million compared to the same quarter in 2004, with both Recorded Music and Music Publishing contributing to growth.
* Digital revenue of $44 million or 6% of total revenue grew by 26% from the second quarter and 76% from the first quarter of fiscal 2005.
* The reported operating loss was $92 million in the quarter. Adjusted for certain non-recurring charges related to the company's initial public offering (IPO) and FAS 123 expenses, operating income rose 33% to $20 million, compared to $15 million for the same period last year.
* Operating income before depreciation and amortization (OIBDA) adjusted for certain IPO-related non-recurring charges and FAS 123 expenses was $79 million up 5% from $75 million for the comparable period last year.
* The company also reported a cash balance as of June 30, 2005 of $265 million and total long-term debt of $2.2 billion.
"Warner Music Group's solid performance in the quarter reaffirms the strength of our strategic plan and the efficacy with which it is being executed by our outstanding management team. Non-Recurring Items
Non-recurring, IPO-related items include the $73 million fee to terminate a management contract in connection with our IPO, $1 million of management fees paid to the Investor Group, certain cash payments to employees totaling $29 million related to the issuance of stock awards below fair market value and payment of an IPO bonus to our employees, as previously disclosed, and $35 million resulting from the payment of redemption premiums and other charges in connection with the previously announced redemption of debt issued by our subsidiary, WMG Holdings Corp. There were also $9 million in FAS 123 expenses in the quarter.
Recorded Music
Recorded Music revenue expanded by 2% to $588 million, led by robust digital sales. Digital Recorded Music revenues of $38 million represented approximately 6% of Recorded Music revenue, up from 5% in the second fiscal quarter of 2005. Major sellers in the quarter were Rob Thomas, Green Day, Michael Bublé, Mike Jones and James Blunt. Recorded Music OIBDA was $47 million for the quarter. Recorded Music adjusted OIBDA (which excludes the non-recurring charges regarding the IPO and FAS 123 expenses) grew 11% to $73 million from $66 million in last year's comparable quarter as higher-margin digital products contributed to results. Recorded Music adjusted OIBDA margin rose one percentage point to 12.4% as compared to the same quarter last year despite rising promotional expenses ahead of a heavier fourth quarter release schedule. Recorded Music operating income was $6 million for the quarter. Recorded Music adjusted operating income (which excludes the non-recurring charges regarding the IPO and FAS 123 expenses) improved by 33% to $32 million from $24 million in last year's comparable quarter, yielding an adjusted operating margin of 5.4% -- up 1.2 percentage points from 4.2% in the comparable prior year period.
Music Publishing
Music Publishing revenue climbed by 5% to $161 million compared to last year's comparable period. Digital revenue from Music Publishing of $6 million represented 4% of total Music Publishing revenue, up from 3% in the second fiscal quarter of 2005. Increases in synchronization royalties and, to a lesser extent, mechanical revenues, were partially offset by declines in performance royalties and other revenues. Movie, video game and advertisement deals as well as DVDs drove higher synchronization royalties. Lower performance revenues reflect fewer radio hits. Music Publishing operating income was $13 million in the quarter and Music Publishing adjusted operating income (which excludes the non-recurring charges and FAS 123 expenses) was $15 million up 15% from the prior year quarter. Music Publishing OIBDA was $28 million for the quarter. Music Publishing adjusted OIBDA (which excludes the non-recurring charges and FAS 123 expenses) rose 7% to $30 million compared to last year's comparable quarter. Music Publishing adjusted OIBDA margin improved to 18.6% compared to 18.3% and Music Publishing adjusted operating income margin lifted 80 basis points to 9.3% from 8.5% in last year's comparable period.

Hilly Kristal was feeling optimistic.
Though CBGB, the landmark Bowery rock club he founded in 1973, is embroiled in a legal dispute with its landlord and faces eviction at the end of the month when its lease expires, there were signs, Mr. Kristal said, that an agreement would be reached soon.
"I think it's going to be settled amicably," he said by phone last week from his office at the club, where, at 73, he still arrives early each morning and answers the phone with a quick, cordial "CB's."
But as Mr. Kristal discussed the situation, his attitude changed. He said he was certain that his landlord - the nonprofit Bowery Residents' Committee, which aids about 8,000 homeless people each year - "wants me out," and he soured on the prospects of a new lease.
Then he excused himself to go to a meeting where, Mr. Kristal said, he would discuss moving the club to Las Vegas.
"If New York doesn't want me," he said, "then I'll try to do something else. There are people out there who do want me."
With 31 days left in its lease, CBGB's future remains uncertain, and though a motley group of celebrities, public relations specialists and punk activists have worked steadily in recent weeks to help the club negotiate with its landlord, no agreement has been reached, and stomachs have tightened all around.
Today, Steven Van Zandt, of the E Street Band and "The Sopranos," who has been leading the celebrity volunteer effort to save the club, is to announce an Aug. 31 rally, planned for Washington Square Park. Depending on the success of a proposal that Mr. Van Zandt's team has submitted to the committee on behalf of the club, the rally could be CBGB's last hurrah or the start of its new life.
"This is the last rock 'n' roll symbol left," Mr. Van Zandt said. "We have seen one iconic rock 'n' roll venue after the other disappear, and we finally said, 'Let's draw a line here, and save at least one.' "

O.J. kicked out of sports show in Rosemont
What did he expect?
O.J. was in the house -- so they booted him.O.J. Simpson -- acquitted of killing his ex-wife and her friend nearly 10 years ago -- showed up to sign autographs at the National Sports Collectors Convention in Rosemont on Saturday but was asked to leave within an hour, convention organizers said.
Celebrities need prior approval to sign autographs at the show, and neither Simpson nor the exhibitor that apparently invited him had sought permission, convention spokesman Bob Ibach said.
And even if they had, Simpson likely wouldn't have gotten it.
"The subject of Simpson one day being a guest has been raised in the past and has been strongly opposed by the board of directors," said Bob Byer, the convention's director.

Global Music International, Inc. Signs Content License Agreement With MobileVision Communications Ltd Beijing China
Global Music International, Inc. intending to provide music video content to the wireless telecom industry through known content distributors, announced that Mobilevision Communications Ltd. Beijing, China (Mobilevision) has informed Global that MobileVision intends to launch Global's music video programming on China Unicom's mobile phone network on or about August 1st. The streaming media service by MobileVision is initially offered as a pilot commercial program without charge. Global agreed to participate in this pilot program by providing the content to MobileVision without charge during this period.
Starting on October 1, 2005, Mobilevision intends to charge for the streaming service. The revenue sharing and payment terms between Global and MobileVision will take effect starting on the same date of commercial service. The program will become a subscription-based service as a stand-alone premium channel. MobileVision will also be making available the music video content from Global on its WAP Portal pages http://www.looklook.cn and in links contained in its WAP push messages through China Unicom's network.
Global entered into a content license agreement with Mobilevision Communications Ltd. Beijing, China for distribution of its music video programming on a subscription basis for broadcast on mobile phones in China on July 13, 2005 (See 8k) 7/15/05. The terms of the agreement give Mobilevision the rights, on a non-excusive basis, to distribute Global's music video content and to promote and market Global's music video programming in China. In addition, Mobilevision will handle all streaming and encoding of Global's content, as well as track, receive and distribute payment to Global on a monthly basis. The term of the agreement is for one year with automatic renewals subject to Global's approval.

British record industry reaches settlement over illegal Internet downloads
LONDON (AFP) - About 23 Britons who illegally downloaded music from the Internet for free have agreed to pay a settlement for the piracy, the record industry said.The deal, considered a first for the industry, involves an average payment of 2,000 pounds (2.900 euros) for each offender, and almost double that amount for the person who pirated 9,000 titles.
"We have no desire to drag people through the courts, so we have attempted to reach fair settlements where we can," said Geoff Taylor, a representative of the British Phonographic Industry, an organization of music editors.
Those who accepted the deal to compensate the record industry include 17 men and six women, aged 22 to 58. Three people declined the settlement and will be taken to court.
The industry has seen a decline in single record sales since 1989, while albums have continued to increase.
However, the music sector is concerned that album sales will also drop as more people use the Internet where they can download music faster and cheaper. [LINK]

China Sings! Chinese pop music gets its props
Chinese-language pop music by some of Asia's biggest stars will be available online for the first time in North America and Europe from tomorrow (8), as the result of a ground-breaking partnership between Universal Music South East Asia and Apple's iTunes Music Store (iTMS).In a campaign launched to coincide with the start of the Chinese Lunar New Year, the best of Cantonese ("Canto-pop") and Mandarin ("Mando-pop") hits by Jacky Cheung, Kelly Chen, Hacken Lee, Alan Tam and many other top artists will be available from iTunes stores in 15 countries, including the U.S., the U.K. and Canada.
Consumers will be able to choose from more than 1,000 tracks by Universal Music's roster of Chinese artists, in a campaign which represents an industry milestone - the first time that this volume of Chinese repertoire will become available online legally outside its region of origin.
Aimed in particular at the large overseas-Chinese population, the offering allows consumers who live far from the countries where the recordings were originally released to buy them quickly and conveniently. In the past, such music has usually been available only in physical form through a limited number of specialist retailers.
"The new deal is a fantastic development for everyone," said Kelly Chen, one of Universal Music's most popular artists in Asia, whose music will be now available through iTMS. "Fans everywhere can keep up-to-date with our music, while artists are respected and protected on a copyright level," she added.
The tracks will be available for download from February 8. In addition to the performers named above, music by Sam Hui, Andy Lau, Faye Wong, Grasshopper, Leon Lai, Tat Ming Pair and Michael Kwan, among others, will be available. The repertoire will be permanently available on iTMS, and will be augmented in the future by new Chinese releases and select catalogue titles.

From 1997 through 1998, Israelite became the youngest Administrative Assistant in the US Senate when he served under Missouri Senator Kit Bond, taking the reigns as the Senator's Campaign Manager during his successful re-election campaign in 1998.
From '94 to '97, Israelite practiced law in the Commercial Litigation Department at the firm of Bryan Cave, LLP in Kansas City, Missouri. Israelite earned his Juris Doctor from the University of Missouri in 1994 and received a B.A. in a double major of Political Science and Communications from William Jewell College in 1990. While in college, Israelite was named Top Speaker by the National Cross Examination Debate Association, recognizing him as the nation's top collegiate debater. Israelite has been recognized as one of "Politics Fabulous Fifty" by Roll Call newspaper, a "Rising Star of Politics" by Campaigns and Elections Magazine, and one of Details Magazine's "50 Most Powerful Men under 38".

Monica A. Coates named Director of A&R for Verity Records
Jazzy Jordan, Senior Vice President and General Manager, Verity Records and Senior Vice President of Black Music Marketing, Jive Records has appointed Monica A. Coates to Director of A&R for Verity Records. Coates will oversee all of Verity’s daily functions of the A&R Department and serve as the A&R point person for the album and video projects for Verity Artists which include Donnie McClurkin, Hezekiah Walker, Fred Hammond and Vickie Winans. Coates will be based in New York.Coates recently served as Associate Director of A&R for Verity Records and was responsible for top-selling releases from Vickie Winans, Fred Hammond and WOW Gospel 2005. RIAA Submits Report To Federal Government Outlining Piracy Problems In More Than 60 Countries
[The Recording Industry Association of America (RIAA), together with associations representing other sectors of the U.S. copyright industry, who collectively constitute the International Intellectual Property Alliance (IIPA), today filed a report with United States Trade Representative (USTR) identifying copyright problems more than 60 countries. The report was submitted under a provision of trade law known as "Special 301" through which USTR identifies countries whose performance in the protection of intellectual property is inadequate. Identification under Special 301 can have a number of ramifications, and can lead to the imposition of sanctions (for countries identified as Priority Foreign Countries), the suspension of trade benefits under programs such as General System of Preferences, the initiation of disputes in the World Trade Organization or under other regional and/or bilateral agreements. "America's cultural industries represent the social and economic vanguard of our nation, and are at the heart of America's present and future global competitiveness. The importance of our industries, and consequently of effective copyright protection, has been increasingly recognized by all branches of the U.S. government. Today, even as we identify the many problems that we confront in foreign markets, we salute the tremendous efforts of USTR and the entire Administration and Congress in pressing for reform. Their efforts have been truly remarkable.
"Today's filing reinforces a submission made earlier this week by the same coalition of copyright industries proposing that USTR initiate consultations with China in the WTO. We also propose that USTR identify Russia as a Priority Foreign Country, and immediately suspend its eligibility to participate in the Generalized System of Preferences program (GSP) under which many of its goods receive favorable treatment when entering the United States. A nation whose de facto policy permits the unchecked activity of commercial pirates should not be granted favorable treatment, and we hope that Russia will soon take steps to address a problem that has lingered for far too long. We also call on USTR to maintain the Priority Foreign Country status of neighboring Ukraine, a country that has failed to fulfill all of its commitments on copyright enforcement. We are, however, encouraged by the arrival of a new and pro-active government, which raises hope for a rapid solution of our outstanding problems in Ukraine"
"In other highlights of the report, we reiterate our concerns about rampant piracy in Brazil, and renew our recommendation to USTR that they remove Brazil's eligibility under GSP for that country's failure to take effective action against a piracy situation that is decimating their own and U.S. copyright industries. The Brazilian Government's refusal to take meaningful action is hard to understand, particularly in light of the impact on its local creators, and the fact that the Brazilian Congress communicated a detailed report to the Lula Administration more than six months ago highlighting the negative impact of piracy on the Brazilian economy, and recommending a number of specific actions. We also propose that Pakistan be identified as a Priority Foreign Country for its failure to adequately address the mass production and export of pirate discs. Pakistan has emerged as one of the world's leading exporters of pirate product, and it, and we, can simply not afford to permit such continued lawlessness."
"Our report also highlights some positive developments in a number of key territories, including Mexico, Spain and Paraguay. In each of these countries, however, piracy continues to greatly prejudice the vitality of the record industry, and we urge these governments to build on present efforts and expand their reach and effectiveness. In Mexico, the Office of the Attorney General has really stepped up activity, but the system as a whole still fails to provide deterrence, and more resources are needed. In Spain, the government has also enhanced its enforcement efforts, but the situation remains dire for the record industry, and we hope that plans recently announced by the government will fully integrate all agencies that can play a role in effecting meaningful and systematic change. In Paraguay, President Duarte-Frutos has launched an impressive campaign against corruption, and Minister of Industry and Commerce Bergen has directed an initiative aimed at rooting out criminal enterprises involved in copyright piracy. While much remains to be accomplished, the political will of this Government to significantly alter the situation in Paraguay is palpable, and the future looks bright." [press release]

RIAA And Other Intellectual Property Groups Seek World Trade Organization Help In Cracking Down On Piracy In China
The nation's leading intellectual property trade organizations, including the Recording Industry Association of America (RIAA), dramatically stepped up their calls for greater anti-piracy enforcement by the Chinese government.Responding to a request from the U.S. Trade Representative (USTR) for public comments on the adequacy of China's enforcement of intellectual property laws, the International Intellectual Property Alliance, which includes copyright groups like the RIAA, submitted a report that outlined the magnitude of the harm that America's copyright industries suffer because of China's failure to comply with it's international obligations. The intellectual property rights groups' submission requests that China's failure to crack down on intellectual property theft be brought before the World Trade Organization (WTO) and that China be placed on the U.S. government's Special 301 "priority watch list" – countries that USTR determines present significant piracy problems for U.S. rightholders.
This would be the first time ever that China's intellectual property enforcement issues would be raised with the WTO, the international body formed to resolve trade disputes.
"Despite a number of sometimes encouraging commitments, and notwithstanding the tremendous efforts of Ambassador Zoellick, Secretary Evans and entire Administration, China has failed to follow through on meaningful copyright protection and enforcement against the widespread piracy of our industry's products," said Neil Turkewitz, Executive Vice President, International, RIAA. "Our report to the trade representative describes in detail the magnitude of the problems that the nation's copyright industries continue to face in China. This is primarily due to China's failure to comply with multiple agreements that would have greatly strengthened the enforcement of intellectual property laws. The situation in China is further exacerbated by China's failure to provide greater access to its markets, thus limiting the supply of legitimate materials—a demand that is currently primarily met by Chinese pirates."
"Piracy rates for copyrighted material continue to hover around 90 percent," Turkewitz added. "Given the enormity of the problem, we believe that these issues deserve to be elevated to consideration by the WTO."
In addition to the submission by the U.S. intellectual property groups, the record industry's international trade organization, IFPI, has also recently highlighted the reoccurring problem of intellectual property theft in China. Jay Berman, the former Chairman of IFPI, testified before the US-China Economic and Security Review Commission on February 4. Berman emphasized two key priorities for the recording industry in China: first, the serious problem of enforcement in a market that is dominated by pirate recordings, despite increased raids undertaken and discs seized; and second, the market access barriers that continue to prevent entry for international recordings despite an increase in the number of titles officially sanctioned for release. Radio Tops $20 Billion in 2004 Revenue Marking Its Biggest Year Ever
NEW YORK, NEW YORK - February 1, 2005 - Radio revenues topped the $20 billion mark in 2004 with a total increase in spot and non-spot dollars of 2% over last year. Local ad sales were the most robust, growing 3% over 2003. National ad dollars remained stable, coming in flat for the year. Network ad figures grew 5% this year over last. The total combined local, national, and network ad sales revenue for 2004 was up 2% compared to 2003. Non-spot revenue climbed 11% in 2004.Fourth-quarter 2004 figures also showed healthy signs of recovery for the industry, particularly in the national sector, which rose 3% when compared to 4th quarter of 2003. Local ad sales remained flat in 4th quarter of 2004 compared to 4th quarter of 2003. Total combined local and national ad revenue for the last three months of the year grew 1% over that same time period from last year. Non-spot revenue was up 10% in 4th quarter of this year compared to last year. Total spot and non-spot Radio revenue for the last three months of 2004 climbed 1% compared to that same time period from a year ago.
While 4th quarter of 2004 was strong, the month of December was less than vigorous. Total spot and non-spot dollars dipped 1% when compared to December of 2003. Local ad sales were down 1% this December compared to last December. National ad sales figures also dropped 5% in December 2004 compared to December 2003. Total combined local and national ad sales for the month of December 2004 declined 2% compared to December 2003. Non-spot dollars for the month increased 12% over last December.
"Radio continues to be attractive to advertisers because it continues to grow its audience and deliver consumers," noted Gary Fries, President and Chief Executive Officer of the Radio Advertising Bureau (RAB). "In the past year alone, the number of listeners to terrestrial Radio has grown by over 3.5 million consumers nationwide (RADAR 83, fall 2004 vs. RADAR 79, fall 2003). Moreover, terrestrial Radio's audience has grown an astounding 10.7 million listeners in just the past four years (RADAR 67, fall 2000)."
These monthly totals are based on the RAB Radio Revenue Index of more than 150 markets. The accounting firm of Miller, Kaplan, Arase & Co. provides the local and national revenue data on the more than 150 markets RAB uses to calculate its Revenue Index. Non-Spot data has been collected and audited since January of 2002, and reported since September of 2004.

EMI profit warning after CDs delay

LONDON, England (Reuters) -- Britain's EMI, the world's third-largest music group, warned on profits Monday following delays in releasing two of its major albums.Its shares fell 15 percent in pre-trade after it said music sales would be 8 to 9 percent lower than last year. At 0930 GMT in trading in London after they were 14.3 percent down.
Profit before tax, amortization and exceptional items for the year ending March 31 will be about £138 million pounds ($259.8m), it said in a trading update -- about 17 percent lower than analyst forecasts.
"Two major albums, one by Cold Play and one by Gorillaz, originally scheduled for this financial year will now be released in the first half of the next financial year," EMI said in a statement.
"EMI Music's sales, particularly re-orders, in January have also been lower than anticipated and this is expected to continue through February and March," it added.
Paul Richards, an analyst at Numis Securities, said the market would be focusing on the slump in music sales rather than the timing of the two albums.
"It's unusual to see this much of a downgrade just because of phasing," he said.
Shares in EMI dropped 15 percent in pre-trade, with a line of 250,000 shares going through at 240 pence, down 15 percent from the stock's closing price of 281-1/4p on Friday.
At 0930 GMT they were 40.25 points down (14.3 percent) at 241.00.
Alain Levy, chairman and chief executive of EMI Music, said: "Creating and marketing music is not an exact science and cannot always coincide with our reporting periods.."

'Suge' Knight Arrested In California
Rap mogul Marion "Suge" Knight was booked on suspicion of violating his parole after police found marijuana in his truck during a traffic stop. Knight was arrested last night (Feb. 5) in Barstow, Calif., and held by sheriff's officials pending his transfer next week to state prison, said sheriff's Cpl. Lorraine Riser.State officials would then review his case to determine if he should be held or released, Riser said. Police searched Knight's Ford pickup and found marijuana after pulling him over for making an unsafe U-turn. He was also cited for not having insurance. [ARTICLE]

IFPI welcomes first court decision in France against illegal file-sharing
File sharing issues are now being addressed in international courts. The following lists the first French prosecution of an individual accused of illegal file-sharing.
IFPI welcomes the landmark decision by the Tribunal of Pontoise to fine one of the heaviest uploaders of music in France. This is the first time that an individual has been sentenced for illegal file-sharing on a P2P network in the country.The decision sets an important precedent and confirms the illegal nature of sharing music files without the permission of the rights holders.
"Alexis B", a school teacher, was fined 10,200 euros after being found guilty of illegally downloading and making available 30GB of files, or a massive 10,000 songs/614 albums. In addition, he was ordered to cover the costs of publishing the judgement in two French broadsheets Liberation and Le Parisien. The publication of the ads will act as a reminder and deterrent to all those who are exposing themselves to the same risks of legal action.
John Kennedy, Chairman and CEO of IFPI said: "We take no pleasure in resorting to lawsuits against illegal file-sharing, but we are encouraged by this French judgement. This sends out a clear message to all those who think they can get away with the illegal mass distribution of music files on a P2P network: you are not immune, you are not anonymous and there are consequences. Music is widely available to buy legitimately online – if you want to avoid the risk of a fine it’s easy, download legally."

R. Kelly, Jay-Z & Pepper Spray: Un-Finished Business "The Best of Both Worlds" Tour over?
It's been no secret the R. Kelly and Jay-Z have been feuding during the Best of Both Worlds tour. For the two artist, the tour has been anything BUT the best of both worlds. It seems that Kelly has been more than a bit envious of the audience reception for his touring partner, Jay-Z. The tour is now in doubt after Kelly walked offstage during a performance Saturday and then was alledgedly pepper sprayed by a member of Jay-Z's entourage.
NEW YORK - The tumultuous tour pairing platinum-selling stars R. Kelly and Jay-Z came to an abrupt end Saturday, one day after Kelly walked offstage during a performance and allegedly was blasted with pepper spray by a member of Jay-Z's entourage.
Kelly was booted from shows Saturday and Monday at Madison Square Garden by the promoter, who told the "I Believe I Can Fly" singer that he was banned from the facility, said his publicist, Allan Mayer. The promoter announced that Jay-Z, with special guests, would do the shows alone.
"The fans deserve better than this," Kelly said in a statement. "I'd like the show to go on. It's really disappointing that Jay-Z and the promoter don't."
Jay-Z and R. Kelly were in the midst of a 40-city "Best of Both Worlds" tour, which has been beset by canceled shows and reports that the feuding performers weren't even on speaking terms.
The tour, which had been scheduled to run through Nov. 28, has been canceled, said promoter Jeff Sharp of Atlanta Worldwide Touring. Jay-Z's publicist was unsure if the rapper would try and fill the remaining dates as a solo act.
The pepper-spray incident happened about an hour into Friday night's show, when Kelly walked on stage and said he saw two people in the audience waving guns, Mayer said. Kelly abruptly stopped his set around 9:30 p.m. while arena security employees searched for weapons.
Finding none, guards told Kelly it was safe to continue performing, Mayer said. But as the singer was making his way back to the stage, a man in Jay-Z's entourage — apparently miffed that Kelly interrupted the show — sprayed him and two of his bodyguards in the face, Mayer said.

File Sharers Win More Protection
Alleged file sharers must be given a notice explaining their legal rights before their internet service provider hands over any personal information to the music labels, a Pennsylvania judge ruled, making it still harder for the music industry to use the courts to intimidate people suspected of piracy.Privacy advocates called the Oct. 12 order by U.S. District Judge Cynthia Rufe a positive step in protecting the privacy and due process rights of accused copyright infringers.
The Recording Industry Association of America has filed thousands of so-called "John Doe" lawsuits, where the industry's trade association sues people based on their internet protocol addresses without knowing their names. The RIAA must first obtain an order from a judge to subpoena the internet service providers for the name of the defendant. With Rufe's order, now ISPs in the Eastern District of Pennsylvania must provide a detailed notice to their customer advising them of their rights, before they hand over their customers' names to the music companies' lawyers.
"It's another step in the evolution of protections for people who are accused by the record labels of file sharing, but may have a defense and may want to protect their anonymity," said Wendy Seltzer, an attorney with the Electronic Frontier Foundation, an organization that filed a friend-of-the-court brief in the case. "It puts some procedural safeguards into the process."
The RIAA did not return a request for comment.
